Legal Aid : June 2018 Abstract: Learning the law is an online teachers’ kit of simplified education materials addressing the legal issues associated with fines, driving, sexting and consent. Victoria Legal Aid’s (VLA’s) Community Legal Education (CLE) program produced the kit for high school teachers of students with a mild intellectual disability. It includes lesson plans, short videos, teachers’ notes and online modules of interactive activities. The kit was launched in 2015 with modules on two topics– fines and driving. Additional modules on sexting and consent were added in 2017. These topics were chosen after extensive consultation with principals and teachers in specialist schools about what sort of legal education would benefit their students. The Department of Education and Training was also consulted and their specialist staff provided advice and support in the development of the project. Victoria Legal Aid provides free professional development sessions for teachers in Victorian schools to assist them to use the modules in the classroom. This study was planned from the outset of the project and focuses on the Fines module of the kit. This module addresses public transport infringements contains clear messages to help young people understand their legal rights and responsibilities when relying on public transport in Victoria. Inclusion is most often considered within socio-historical and socio-political contexts, whereby technical and legislative responses are sought. However, this book explores the question, "How ethically defensible is the notion of inclusion in relation to people with intellectual disability?" The book contends that inclusion is a multifaceted, complex concept in a dualistic and dichotomous relationship with exclusion. It is argued that historical and contemporary conceptualisations of exclusion for people with intellectual disability have been constructed from various philosophical and theological matrices imbued with particular values about personhood. Furthermore, it is proposed that the ethical significance of inclusion and exclusion in the context of intellectual disability is defined and perpetuated by expressions of a particular socio-symbolic order underpinned by patriarchy and kyriarchy, and subjected to two controlling ethics - an Ethic of Normalcy and an Ethic of Anomaly. Inclusion and exclusion are conceived as phenomena relating to how membership is defined, legitimated, or repelled by concealed, occluding boundaries acting within a patriarchal socio-ethical fabric. The book argues that Ethical Inclusion is only possible through the rupture of these boundaries by a conceptual tool, 'A Transformatory Ethic of Inclusion'. This conceptual instrument of rupture embraces the scholarship of feminist ethics and feminist theology. Such a rupture requires examining the ways traditional ethical frameworks themselves have conceptually diminished and devalued the authenticity of people with intellectual disability. A concept of integrality becomes imaginable. Conceptual analysis is framed using a crafting metaphor of a patchwork quilt which is infused with narrative; and by which, such an ethical exploration is undertaken, and impaired, traditional ethical theorising is confronted and transformed. The Panel was an independent statutory body, separate from the government department responsible for delivering disability services. The Panel's role was to protect and promote the rights of people with an intellectual disability in Victoria. Its four key functions under the IDPS Act were: to provide independent review of decisions on eligibility for services, general service plans, admission to institutions and the use of restrictive practices; to monitor the use of restrictive practices such as seclusion, chemical or mechanical restraints; to review the cases of people with an intellectual disability who had become security residents through the criminal justice system; to make recommendations and provide advice to the Secretary of the Department and the Minister for Community Services. The Panel provided 'a place to be heard' for people with an intellectual disability, their families and advocates. The Panel did not have the authority to make orders about what should happen, despite many calls being made for it to be given these vital determinative powers. It refers to contemporary definitions and research findings that have contributed to the way the human services sector has addressed these parents. It also includes a review of the literature to identify the factors contributing to an over-representation of parents with learning difficulties in the child protection system. This paper describes the major practitioner tasks regarding parents with learning difficulties — assessment and intervention (it is noted that several questionable assumptions about these tasks have been made over the years, with regrettable implications for practice). The paper also highlights practical strategies that have proven effectiveness in working with such families. It is important to note that throughout this paper an ecobehavioural perspective is taken to working with families. This implies an appreciation of the idea of the family as a system that is embedded within a broader social and environmental context. The paper emphasises the supports needed to achieve the new skills and environmental changes required to improve parenting practices and family functioning. Supports oriented towards modifying social environments, such as social supports, advocacy, housing, access to mainstream services and changing attitudes and prejudicial beliefs in the community, are extremely important, but are beyond the scope of this paper.
